These Terms of Service (“Terms”) govern your access to and use of BIShare’s mobile applications, desktop applications, website, and related services (collectively, the “Service”) operated by BIShare (“we,” “our,” or “us”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian’s permission to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.
2. Description of Service
BIShare provides the following services:
- Local File Transfer. Direct peer-to-peer file sharing between devices on the same local network, without server intermediation.
- Remote File Transfer. Cloud-relayed file transfer for devices on different networks, with temporary server storage (24-hour expiry).
- Web Sharing. Browser-based file upload and download via bishare.app, accessible without installing an application.
- File Requests. The ability to create links that allow others to send files directly to you, with temporary server storage.
- Collaborative Rooms. Temporary shared spaces where multiple users can share files simultaneously.
The Service is provided “as is” and “as available.” We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
3. Acceptable Use
You agree NOT to use the Service to:

| Automation | Use bots, scrapers, or automated tools to bulk upload or download files |
| Spam | Use file request links or share links for unsolicited distribution or phishing |
We reserve the right to refuse or remove a transfer and to block access to the Service where these policies are violated, without prior notice.
4. Service Limits

We reserve the right to modify these limits at any time. Exceeding these limits may result in temporary restrictions or blocked access to the Service.
5. Intellectual Property
5.1 Your Content
You retain full ownership of all files and content you share through BIShare. By uploading content, you grant us a limited, non-exclusive license to store, transmit, and deliver your content solely for the purpose of providing the Service. This license terminates when your content is deleted from our servers.
5.2 Our Intellectual Property
The BIShare name, logo, website design, application code, and related intellectual property are owned by BIShare. You may not copy, modify, distribute, or create derivative works of our intellectual property without written permission.
6. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THAT FILES WILL BE DELIVERED SUCCESSFULLY OR THAT DATA WILL NOT BE LOST.
We recommend maintaining backup copies of important files. BIShare is not intended to be a primary backup solution.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BISHARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, BUSINESS INTERRUPTION, OR UNAUTHORIZED ACCESS TO YOUR FILES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
9. Indemnification
You agree to indemnify, defend, and hold harmless BIShare and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third party’s rights.
10. Termination
- By You. You may stop using the Service at any time. Simply uninstall the app or discontinue use — no cancellation step is required.
- By Us. We may block your access to the Service at any time, with or without cause, including for violations of these Terms.
- Effect of Termination. Upon termination, your right to use the Service ceases immediately. Any files held in temporary server storage are deleted in accordance with our data retention policies.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BIShare operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.
12. Changes to These Terms
We reserve the right to update these Terms at any time. Material changes will be communicated by posting the revised Terms on this page and updating the “Last updated” date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
